Денес, повеќе од кога и да е, ни требаат сонувачи. Ни требаат сонувачи кои го споделуваат сонот за правдата и човечноста, слободата и еднаквоста, каков што е сонот на д-р Мартин Лутер Кинг Помладиот.

По повод Денот на Мартин Лутер Кинг, 15 јануари, ве повикуваме да го посветите овој викенд на вашите сништа и на сништата на вашите сограѓани на светот. Што можете да сторите? Ме радува што денес, заедно со вас, можам да учествувам на едно збиднување што ќе влезе како најголема демонстрација за слободата во историјата на нашата нација.

Пред сто години еден голем Американец, под чија симболична сенка денес стоиме, ја потпиша прокламацијата за еманципација. Тој се појави како радосна зора по долгата ноќ на ропството.

Но, сто години подоцна црнецот сẻ уште не е слободен. Сто години подоцна животот на црнецот е сẻ уште подгрбавен од ланците на расната поделба и ланците на дискриминацијата. Сто години подоцна црнецот сẻ уште живее на работ на американското општество и во спствената земја се наоѓа во бегство.

Затоа денес дојдовме овде за да драматизираме една срамна состојба. Во одредена смисла станавме главен град на нашата земја за да материјализираме чек. Не оставајте нẻ да пиеме од горчливоста и омразата, за да ја смириме нашата жед за слобода. Нашата борба мораме постојано да ја водиме на нивото на достоинството и дисциплината. Sot, më shumë se kurr, na duhen ëndërrues. Na duhen ëndërrues të cilët e shpërndajnë ëndrrën e drejtësisë dhe njerëzisë, lirisë dhe barazisë, siq është ëndrra e d-r Martin Luther King-ut më të Riut.

Me rast të Ditës së Martin Luther King, 15 janar, ju thërrasim ta kushtoni këtë uikend ëndrrave tuaja dhe ëndrrave të bashkëqytetarëve tuaj në botë. Ç’ka mund të bëni? Ky shënim ishte një premtim se të gjithë njerëzit, po, njerëz të zinj dhe të bardhë, do t’i garantoheshin të drejtat e patjetërsueshme të jetës, liria dhe kërkimi i lumturisë. Është fare e qartë sot se Amerika nuk i ka plotësuar zotimet e premtuara, për sa i përket qytetarëve me ngjyrë. Në vend që të nderojnë këtë detyrim të shenjtë, Amerika u ka dhënë popullit zezak një çek të keq, një çek në të cilin shënohen “fonde të pamjaftueshme”.

Por ne refuzojmë të besojmë se banka e drejtësisë ka falimentuar. Ne refuzojmë të besojmë se nuk ka fonde të mjaftueshme në kupën e madhe të mundësive të këtij kombi. Prandaj ne kemi ardhur ta marrim këtë çek, një çek që do të na japë mbi kërkesën e pasurisë, lirinë dhe drejtësinë.

Tani është koha t’i bëjmë të vërteta premtimet e demokracisë. Tani është koha ta bëjmë drejtësinë një realitet për të gjithë fëmijët e Perëndisë. Do të ishte fatale sikur ky komb të tejkalonte urgjencën e momentit. Njëmijë e nëntëqind e gjashtëdhjetë e treshi nuk është fundi, por fillimi. Vorbulla e revoltës do të vazhdojë të tundë themelin e kombit tonë deri në ditën e shndritshme që drejtësia do të lindë.

Duhet t’i them diçka atyre që qëndrojnë në pragun e ngrohtë, që i drejton në pallatin e drejtësisë. Në procesin për të fituar vendin tonë të drejtë, ne nuk duhet të ndihemi fajtorë për veprimet tona të gabuara. Kam një ëndërr se një ditë çdo luginë do të lartësohet dhe çdo kodër dhe mal do të ulet, vendet e ashpra do të sheshohen dhe vendet e lakuara do të bëhen të drejta, dhe lavdia e Perëndisë do të zbulohet dhe të gjithë do ta shohin së bashku.

Kjo është shpresa jonë. Ky është besimi me të cilin kthehemi në Jug. Me këtë besim do të jemi në gjendje ta kthejmë malin e dëshpërimit në një gur shprese. Me këtë besim do të jemi në gjendje ta transformojmë disharmoninë e kombit tonë në një simfoni të bukur të vëllazërisë. Me këtë besim ne do të jemi në gjendje të punojmë së bashku, për të luftuar së bashku, për të mbrojtur lirinë së bashku, me dijen se një ditë do të jemi të lirë. Dhe kjo do të jetë dita kur fëmijët e Perëndisë të jenë në gjendje të këndojnë së bashku me një kuptim të ri “Vendi im është toka e ëmbël e lirisë. Toka ku stërgjyshërit kanë vdekur, toka e krenarisë së pelegrinëve, nga çdo majë mali le të këndojë liria”. Dhe nëse Amerika do të bëhet një komb i madh, kjo duhet të bëhet e vërtetë.

Kështu lëreni lirinë të kumbojë nga majat e kodrave të Nju Hemshajërit.

Lëreni lirinë të kumbojë nga malet e gjera të Nju Jorkut.

Lëreni lirinë të kumbojë nga lartësitë e Pensilvanisë.

Lëreni lirinë të kumbojë nga shkëmbinjtë me dëborë të Kolorados.

Lëreni lirinë të kumbojë nga pjerrësirat e Kalifornisë.

Por jo vetëm kaq. Lëreni lirinë të kumbojë nga mali i gurit të Xheorxhisë.

Lëreni lirinë të kumbojë nga mali i Tenesit.

Lëreni lirinë të kumbojë nga çdo kodër dhe pirg dheu i Misisipit, nga çdo krah mali, lëreni lirinë të kumbasë!

Dhe kur kjo të ndodhë, kur ta lejojmë lirinë të kumbojë, kur ta lëmë të kumbojë nga çdo fshat dhe çdo katundth, nga çdo shtet dhe çdo qytet, do të jemi në gjendje të përshpejtojmë ditën kur fëmijët e Perëndisë, të bardhët dhe të zinjtë, hebrenj dhe paganë, protestantë dhe katolikë, do të bashkojnë duart dhe të këndojnë fjalët e ritmit shpirtëror të negërve “Më në fund të lirë, më në fund të lirë. Lavdi Zotit të Plotfuqishëm, jemi më në fund të lirë”.

Today, more than ever, we need dreamers. We need dreamers that have a shared dream of justice and humanity, freedom and equality, such as the dream of Dr. Martin Luther King Jr.

On the occasion of Martin Luther King’s Day (January 15), we call upon you to dedicate this weekend to your dreams and the dreams of your fellow citizens of the world. What can you do? Read the speech of Martin, spread the word, tell people that dreams may become reality, only if we share it and spread it amongst each other. Reality based on dreams like this is the reality of a humane world.

Don’t be afraid to dream about justice and freedom. Don’t be afraid to demand respect and fulfillment of your dreams. Demand, so they will come true.

Remember January 15, as the birthday of a great representative of the human kind, Dr. Martin Luther King Jr. and be a proud and demanding dreamer on this day and the days to come.

I HAVE A DREAM

Dr. Martin Luther King Jr.

Washington, DC, on August 28, 1963

I am happy to join with you today in what will go down in history as the greatest demonstration for freedom in the history of our nation.

Five score years ago, a great American, in whose symbolic shadow we stand today, signed the Emancipation Proclamation. This momentous decree came as a great beacon light of hope to millions of Negro slaves who had been seared in the flames of withering injustice. It came as a joyous daybreak to end the long night of their captivity.

But one hundred years later, the Negro still is not free. One hundred years later, the life of the Negro is still sadly crippled by the manacles of segregation and the chains of discrimination. One hundred years later, the Negro lives on a lonely island of poverty in the midst of a vast ocean of material prosperity. One hundred years later, the Negro is still languishing in the corners of American society and finds himself an exile in his own land. So we have come here today to dramatize a shameful condition.

In a sense we have come to our nation's capital to cash a check. When the architects of our republic wrote the magnificent words of the Constitution and the Declaration of Independence, they were signing a promissory note to which every American was to fall heir. This note was a promise that all men, yes, black men as well as white men, would be guaranteed the unalienable rights of life, liberty, and the pursuit of happiness.

It is obvious today that America has defaulted on this promissory note insofar as her citizens of color are concerned. Instead of honoring this sacred obligation, America has given the Negro people a bad check, a check which has come back marked "insufficient funds." But we refuse to believe that the bank of justice is bankrupt. We refuse to believe that there are insufficient funds in the great vaults of opportunity of this nation. So we have come to cash this check — a check that will give us upon demand the riches of freedom and the security of justice. We have also come to this hallowed spot to remind America of the fierce urgency of now. This is no time to engage in the luxury of cooling off or to take the tranquilizing drug of gradualism. Now is the time to make real the promises of democracy. Now is the time to rise from the dark and desolate valley of segregation to the sunlit path of racial justice. Now is the time to lift our nation from the quick sands of racial injustice to the solid rock of brotherhood. Now is the time to make justice a reality for all of God's children.

It would be fatal for the nation to overlook the urgency of the moment. This sweltering summer of the Negro's legitimate discontent will not pass until there is an invigorating autumn of freedom and equality. Nineteen sixty-three is not an end, but a beginning. Those who hope that the Negro needed to blow off steam and will now be content will have a rude awakening if the nation returns to business as usual. There will be neither rest nor tranquility in America until the Negro is granted his citizenship rights. The whirlwinds of revolt will continue to shake the foundations of our nation until the bright day of justice emerges.

But there is something that I must say to my people who stand on the warm threshold which leads into the palace of justice. In the process of gaining our rightful place we must not be guilty of wrongful deeds. Let us not seek to satisfy our thirst for freedom by drinking from the cup of bitterness and hatred.

We must forever conduct our struggle on the high plane of dignity and discipline. We must not allow our creative protest to degenerate into physical violence. Again and again we must rise to the majestic heights of meeting physical force with soul force. The marvelous new militancy which has engulfed the Negro community must not lead us to a distrust of all white people, for many of our white brothers, as evidenced by their presence here today, have come to realize that their destiny is tied up with our destiny. They have come to realize that their freedom is inextricably bound to our freedom. We cannot walk alone.

As we walk, we must make the pledge that we shall always march ahead. We cannot turn back. There are those who are asking the devotees of civil rights, "When will you be satisfied?" We can never be satisfied as long as the Negro is the victim of the unspeakable horrors of police brutality. We can never be satisfied, as long as our bodies, heavy with the fatigue of travel, cannot gain lodging in the motels of the highways and the hotels of the cities. We cannot be satisfied as long as the Negro's basic mobility is from a smaller ghetto to a larger one. We can never be satisfied as long as our children are stripped of their selfhood and robbed of their dignity by signs stating "For Whites Only". We cannot be satisfied as long as a Negro in Mississippi cannot vote and a Negro in New York believes he has nothing for which to vote. No, no, we are not satisfied, and we will not be satisfied until justice rolls down like waters and righteousness like a mighty stream.

I am not unmindful that some of you have come here out of great trials and tribulations. Some of you have come fresh from narrow jail cells. Some of you have come from areas where your quest for freedom left you battered by the storms of persecution and staggered by the winds of police brutality. You have been the veterans of creative suffering. Continue to work with the faith that unearned suffering is redemptive.

Go back to Mississippi, go back to Alabama, go back to South Carolina, go back to Georgia, go back to Louisiana, go back to the slums and ghettos of our northern cities, knowing that somehow this situation can and will be changed. Let us not wallow in the valley of despair.

I say to you today, my friends, so even though we face the difficulties of today and tomorrow, I still have a dream. It is a dream deeply rooted in the American dream.

I have a dream that one day this nation will rise up and live out the true meaning of its creed: "We hold these truths to be self-evident: that all men are created equal."

I have a dream that one day on the red hills of Georgia the sons of former slaves and the sons of former slave owners will be able to sit down together at the table of brotherhood.

I have a dream that one day even the state of Mississippi, a state sweltering with the heat of injustice, sweltering with the heat of oppression, will be transformed into an oasis of freedom and justice.

I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin but by the content of their character.

I have a dream today.

I have a dream that one day, down in Alabama, with its vicious racists, with its governor having his lips dripping with the words of interposition and nullification; one day right there in Alabama, little black boys and black girls will be able to join hands with little white boys and white girls as sisters and brothers.

I have a dream today.

I have a dream that one day every valley shall be exalted, every hill and mountain shall be made low, the rough places will be made plain, and the crooked places will be made straight, and the glory of the Lord shall be revealed, and all flesh shall see it together.

This is our hope. This is the faith that I go back to the South with. With this faith we will be able to hew out of the mountain of despair a stone of hope. With this faith we will be able to transform the jangling discords of our nation into a beautiful symphony of brotherhood. With this faith we will be able to work together, to pray together, to struggle together, to go to jail together, to stand up for freedom together, knowing that we will be free one day.

This will be the day when all of God's children will be able to sing with a new meaning, "My country, 'tis of thee, sweet land of liberty, of thee I sing. Land where my fathers died, land of the pilgrim's pride, from every mountainside, let freedom ring."

And if America is to be a great nation this must become true. So let freedom ring from the prodigious hilltops of New Hampshire. Let freedom ring from the mighty mountains of New York. Let freedom ring from the heightening Alleghenies of Pennsylvania!

Let freedom ring from the snowcapped Rockies of Colorado!

Let freedom ring from the curvaceous slopes of California!

But not only that; let freedom ring from Stone Mountain of Georgia!

Let freedom ring from Lookout Mountain of Tennessee!

Let freedom ring from every hill and molehill of Mississippi. From every mountainside, let freedom ring.

And when this happens, when we allow freedom to ring, when we let it ring from every village and every hamlet, from every state and every city, we will be able to speed up that day when all of God's children, black men and white men, Jews and Gentiles, Protestants and Catholics, will be able to join hands and sing in the words of the old Negro spiritual, "Free at last! Во текот на проектниот сегмент Човек=Права во декември (2011) имав можност да дискутирам или да се допишувам со повеќе новинари, претставници на граѓанското општество и граѓани. Gjithkush ka të drejtë për një rend shoqëror dhe ndërkombëtar në të cilin mund të realizohen plotësisht të drejtat dhe liritë e shpallura në këtë Deklaratë.

Neni 29

1. Gjithkush ka detyrime vetëm ndaj asaj bashkësie në të cilën është i mundur zhvillimi i lirë dhe i plotë i personalitetit të tij.

2. Në ushtrimin e të drejtave dhe lirive të veta, gjithkush do t'u nënshtrohet vetëm atyre kufizimeve të cilat janë parashikuar me ligj, ekskluzivisht me qëllim që të sigurohet njohja dhe respektimi i nevojshëm i të drejtave dhe lirive të të tjerëve e që të plotësohen kërkesat e drejta të moralit, rendit publik dhe mirëqenies së përgjithshme në shoqërinë demokratike.

1. Gjithkush ka të drejtën e shkollimit. Arsimi duhet të jetë falas, të paktën në shkollat fillore dhe të ulta. Arsimi fillor është i detyrueshëm. Arsimi teknik dhe profesional duhet të zgjerohet e arsimi i lartë duhet t'u bëhet i mundshëm të gjithëve në bazë të aftësisë.

2. Arsimi duhet të drejtohet nga zhvillimi i plotë i personalitetit të njeriut dhe nga forcimi i respektimit të të drejtave të njeriut dhe lirive themelore. Ai duhet të nxisë kuptimin, tolerancën dhe miqësinë midis të gjithë popujve, grupeve të racave dhe besimeve, si dhe veprimtarinë e Kombeve të Bashkuara për ruajtjen e paqes.

3. Të drejtën për të zgjedhur llojin e arsimit për fëmijët e tyre e kanë në rradhë të parë prindërit.

Article 26

(1) Everyone has the right to education. Education shall be free, at least in the elementary and fundamental stages. Elementary education shall be compulsory. Technical and professional education shall be made generally available and higher education shall be equally accessible to all on the basis of merit.

(2) Education shall be directed to the full development of the human personality and to the strengthening of respect for human rights and fundamental freedoms. It shall promote understanding, tolerance and friendship among all nations, racial or religious groups, and shall further the activities of the United Nations for the maintenance of peace.

(3) Parents have a prior right to choose the kind of education that shall be given to their children.

Neni 22

Si anëtar i shoqërisë, gjithkush ka të drejtën e sigurimit shoqëror dhe realizimit të të drejtave ekonomike, sociale, kulturore të domosdoshme për dinjitetin e vet dhe për zhvillimin e lirë të personalitetit, me ndihmën e shtetit dhe bashkëpunimit ndërkombëtar dhe në përputhje me organizimin dhe mundësitë e çdo shteti.

Neni 23

1. Gjithkush ka të drejtën për punë, të zgjedhë lirisht profesionin, të ketë kushte të favorshme pune dhe të jetë i mbrojtur nga papunësia.

2. Gjithkush, pa kurrfarë diskriminimi, ka të drejtë që për punë të njëjtë të marrë rrogë të njëjtë.

3. Gjithkush që punon ka të drejtën për një shpërblim të drejtë dhe favorshëm, në mënyrë që t'i sigurojë atij dhe familjes së tij një jetë që i përgjigjet dinjitetit njerëzor dhe, në qoftë se do të jetë e nevojshme ky shpërblim të plotësohet edhe me mjete të tjera të sigurimit shoqëror.

4. Gjithkush ka të drejtë të formojë sindikatë and të bëjë pjesë në të për mbrojtjen e interesave të veta.

Neni 24

Gjithkush ka të drejtë për pushim dhe kohë të lirë, duke përfshirë kufizimin e arsyeshëm të orarit të punës dhe pushimin e paguar periodik.

Neni 25

1. Gjithkush ka të drejtë për një nivel jetese të mjaftueshëm i cili t'i përgjigjet shëndetit dhe jetës së përshtatshme si të atij personalisht, ashtu edhe të familjes së tij, duke përfshirë ushqimin, veshmbathjen, banesën, kujdesin mjeksor dhe shërbimet e nevojshme sociale, si edhe të drejtën për të qenë i siguruar në rast sëmundjeje, papunësie, vejanie, pleqërie dhe raste të tjera të humbjeve të mjeteve për jetesë për shkak të rrethanave të pavarura nga vullneti i tij.

2. Nënat dhe fëmijët kanë nevojë për kujdes dhe ndihmë të posaçme. Të gjithë fëmijët, të lindur brenda ose jashtë martese, gëzojnë të njëjtat mbrojtje sociale.

Article 21

(1) Everyone has the right to take part in the government of his country, directly or through freely chosen representatives.

(2) Everyone has the right to equal access to public service in his country.

(3) The will of the people shall be the basis of the authority of government; this will, shall be expressed in periodic and genuine elections which shall be by universal and equal suffrage and shall be held by secret vote or by equivalent free voting procedures.

Article 22

Everyone, as a member of society, has the right to social security and is entitled to realization, through national effort and international cooperation and in accordance with the organization and resources of each State, of the economic, social and cultural rights indispensable for his dignity and the free development of his personality.

Article 23

(1) Everyone has the right to work, to free choice of employment, to just and favourable conditions of work and to protection against unemployment.

(2) Everyone, without any discrimination, has the right to equal pay for equal work.

(3) Everyone who works has the right to just and favourable remuneration ensuring for himself and his family an existence worthy of human dignity, and supplemented, if necessary, by other means of social protection.

(4) Everyone has the right to form and to join trade unions for the protection of his interests.

Article 24

Everyone has the right to rest and leisure, including reasonable limitation of working hours and periodic holidays with pay.

Article 25

(1) Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control.

(2) Motherhood and childhood are entitled to special care and assistance. All children, whether born in or out of wedlock, shall enjoy the same social protection.

ПРАВО НА СОБИРАЊЕ И ЗДРУЖУВАЊЕ

УНИВЕРЗАЛНА ДЕКЛАРАЦИЈА ЗА ЧОВЕКОВИТЕ ПРАВА, Члeн 20: (1) Сeкoj имa прaвo нa слoбoдa нa мирни сoбири и здружувaњe (2) Никoj нe мoжe дa бидe принудeн дa члeнувa вo нeкoe здружeниe.

Постои голема разлика меѓу правото на мирно собирање (протест) и правото на здружување. Право на мирно собирање, е индивидуално право на сите луѓе да се здружат и колективно да изразат, промовираат и бранат некој заеднички интерес. Правото на мирно собирање во минатото се има покажано како одличен инструмент за искажување на незадоволството од работата на владеачките групи. Ова право не е доволно искористено во Македонија, луѓето или имаат страв од јавно искажување на своето мислење или се несигурни во своите барања. Секоја чест за скорешните граѓански собири, кои сепак беа недоволно поддржани од јавноста.

Слобода на здружување е индивидуално право заедно со други лица колективно да се промовираат заедничките интереси. Ова право е вклучено во поголем број од националните устави и инструменти за човекови права, вклучувајќи ја и Европската конвенција за човекови права и Канадската повелба за права и слободи. Луѓето можат да се здружуваат во политички партии, невладини организации, граѓански асоцијации и други начини кои со здружени сили ќе работат за исполнување на нивните интереси.

Секако, сите овие алатки мораат да бидат искористени доброволно, и никој не смее да биде принуден да ги користи.

E DREJTA PËR TUBIM DHE BASHKIM

DEKLARATA E PERGJITHSHME MBI TE DREJTAT E NJERIUT, Neni 20: (1) Gjithkush ka të drejtën e lirisë së mbledhjes dhe bashkimit paqësor; (2) Asnjeri nuk duhet të detyrohet të bëjë pjesë në ndonjë bashkim.

Ka një dallim shumë të madh mes të drejtës së tubimit (protestës) dhe të drejtës së bashkimit.

E drejta e tubimit paqesor është e drejtë individuale e të gjithë njerëzve të bashkohen dhe të shprehen kolektivisht, të promovojnë ose të mbrojnë ndonjë interes të përbashkët. E drejta e tubimit të qetë në të kaluarën u tregua si një instrument i shkëlqyer për shprehjen e pakënaqësisë nga puna e grupeve në pushtet. Sipas meje, kjo e drejtë nuk është shfrytëzar në mënyrë të mjaftueshme në Maqedoni, njerëzit ose kanë frikë nga shprehja publike e mendimit të vet, ose janë të pasigurt në kërkesat e veta. Shpreh respekt për tubimet e paradokohshme, të cilët, megjithatë, nuk u përkrahën në mënyrë të mjaftueshme nga publiku.

Liria e tubimit është e drejtë individuale, që së bashku me persona të tjerë, në mënyrë kolektive të promovohen interesat e përbashkëta. Kjo e drejtë është e përfshirë në pjesën më të madhe të kushtetutave kombëtare dhe instrumenteve për të drejtat e njeriut, duke e përfshirë edhe Konventën Evropiane për të Drejtat e Njeriut dhe Kartës së Kanadasë për të Drejta dhe Liri. Njerëzit mund të bashkohen në parti politike, shoqata joqeveritare, shoqata qytetare etj., të cilët me forca të bashkuara do të punojnë për përmbushjen e interesave të tyre.

Члeн 16

1. Пoлнoлeтнитe мaжи и жeни, бeз никaкви oгрaничувaњa врз oснoвa нa рaсaтa, нaциoнaлнoстa или рeлигиjaтa, имaaт прaвo дa стaпaт вo брaк и дa oснoвaaт сeмejствo. Ним им припaѓaaт eднaкви прaвa прeд брaкoт, зa врeмe нa брaкoт и пo нeгoвoтo рaскинувaњe.

2. Брaкoт ќe сe склучи сaмo сo слoбoднa и цeлoснa сoглaснoст нa иднитe брaчни другaри.

3. Сeмejствoтo e прирoднa и oснoвнa ќeлиja нa oпштeствoтo и имa прaвo нa зaштитa oд стрaнa нa oпштeствoтo и држaвaтa.

Члeн 17

1. Сeкoj чoвeк имa прaвo нa сoпствeнoст, кaкo сaмoстojнo, тaкa и зaeднo сo други.

2. Никoj нeмa дa бидe прoизвoлнo лишeн oд нeгoвaтa сoпствeнoст.

Члeн 18

Сeкoj имa прaвo нa слoбoдa нa мислaтa, сoвeстa и рeлигиja. Oвa прaвo ja вклучувa и слoбoдaтa - чoвeкoт дa ja прoмeни свojaтa рeлигиja или убeдувaњe, кaкo и слoбoдaтa - чoвeкoт, индивидуaлнo или вo зaeдницa сo други луѓe, привaтнo или jaвнo, дa ja мaнифeстирa свojaтa рeлигиja или убeдувaњe прeку пoдучувaњe, прaктикувaњe, oдржувaњe служби или oбрeди.

Neni 16

1. Burrat dhe gratë në moshë të pjekur kanë të drejtë të lidhin martesë dhe formojnë familje, pa kurrfarë kufizimi për sa i përket racës, shtetësisë ose besimit. Ata kanë të drejta të barabarta si në rastin e lidhjes së martesës, gjatë martesës si dhe në rast shkurorëzimi.

2. Martesa duhet të lidhet vetëm me pëlqimin plotësisht të lirë të personave që do të martohen.

3. Familja është bërthama e natyrshme dhe themelore e shoqërisë dhe ka të drejtën e mbrojtjes nga shoqëria dhe shteti.

Neni 17

1. Gjithkush ka të drejtën të ketë pasuri, si vetëm ashtu edhe në bashkësi me të tjerët.

2. Asnjeri nuk duhet të privohet arbitrarisht nga pasuria e tij.

Neni 18

Gjithkush ka të drejtën e lirisë së mendimit, ndërgjegjes dhe besimit; kjo e drejtë përfshin lirinë e ndryshimit të besimit ose bindjeve dhe lirinë që njeriu, qoftë vetë ose në bashkësi me të tjerët, të shfaqë publikisht ose privatisht, besimin ose bindjen e vet me anë të dhënies së mësimeve, kryerjes së kultit dhe ceremonive fetare.

Article 16

(1) Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution.

(2) Marriage shall be entered into only with the free and full consent of the intending spouses.

(3) The family is the natural and fundamental group unit of society and is entitled to protection by society and the State.

Article 17

(1) Everyone has the right to own property alone as well as in association with others.

(2) No one shall be arbitrarily deprived of his property.

Article 18

Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance.

FREEDOM TO MOVE

We all have the right to go where we want in our own country and to travel as we wish

Universal Declaration of Human Rights: Article 13: (1) Everyone has the right to freedom of movement and residence within the borders of each State. (2) Everyone has the right to leave any country, including his own, and to return to his country.

What is freedom of movement?

The right to free movement or the denial of it, within national and international borders can have profound effects upon other basic human rights also outlined in the Universal Declaration of Human Rights and other treaties.

Without the right to leave ones home, an individual may be politically repressed, prevented from observing his/her chosen religion, prevented from enjoying the basic right to marriage or family life, or blocked from a job or an education that ultimately could enhance his/her quality of life.

Thus, while free movement may seem on the surface to be a fairly minor and obvious human right, it actually is one of the most basic rights that in many nations around the world; when violated, it causes numerous problems and cases of suffering.

Што е слобода на движење?

Правото на слободно движење или неговото негирање во рамките на националните и меѓународните граници може да има длабоки последици по другите основни човекови права кои се наведени во Универзалната декларација за човековите права и другите договори.

Со одземеното право да го напушти домот, едно лице може дабиде политички репресирано, да биде спречено да ја практикува својата религија, да биде спречено да ги ужива основните права на брак и семејство или да биде блокирано да оди на работа или да се образува, што може да влијае на квалитетот на неговиот/нејзиниот живот.

Затоа, иако слободното движење може да изгледа како незначајно и не толку очигледно човеково право, всушност, тоа е едно од основните човекови права за многу нации ширум светот; кога е прекршено, предизвикува бројни проблеми и случаи на страдањел.

УНИВЕРЗАЛНА ДЕКЛАРАЦИЈА ЗА ЧОВЕКОВИТЕ ПРАВА: Члeн 12: Никoj нeмa дa бидe излoжeн нa прoизвoлнo вмeшувaњe вo нeгoвиoт привaтeн и сeмeeн живoт, дoмoт или прeпискaтa, ниту пaк нa нaпaди врз нeгoвaтa чeст и углeд. Сeкoj имa прaвo нa прaвнa зaштитa oд тaквoтo вмeшувaњe или нaпaди.

Член 12 од Универзалната декларација за човекови права гарантира право на приватност. Тоа значи дека никој не смее да се обиде да ги наруши приватноста и угледот на ниеден човек. Никој нема право да влезе во нечиј дом, не смее да ги отвора туѓите писма, да вознемирува некого поединечно или неговото/нејзиното семејство.

Светот воден од растечката потреба од безбедност и од „Војната против теророт“ која ги одбележи изминатите десет години, резултираа со глобална параноја. Често претераните мерки за безбедност вклучуваат 24/7 набљудување на комуникациите и движењето на луѓето грубо кршејќи го правото на приватност.

Република Македонија се соочува со дополнителни предизвици a propos правото на приватност. Набљудувањето и други безбедносни мерки кои (би можеле да) го кршат правото на приватност не се јасно ставени под граѓанска/парламентарна контрола. Под плаштот на безбедноста, борбата против организираниот криминал, сообраќајна безбедност и други изговори, набљудувањето се употребува за да се упадне во животите на луѓето, вклучувајќи ги политичките опоненти, новинарите, независните интелектуалци, активисти за човекови права и на граѓанското општество – се обвинува од различни извори. Не постои лесен начин тие наводи и да се докажат, имајќи ја предвид природата на овие активности, како и на институциите кои имаат капацитет за кршење на ова право.

RIGHT TO PRIVACY

Universal Declaration of Human Rights: Article 12: No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honor and reputation. Everyone has the right to the protection of the law against such interference or attacks.

The Article 12 of the Universal Declaration of Human Rights guarantees the right to privacy. That means that nobody should try to harm our good name. Nobody has the right to come into our home, open our letters, or bother us or our family.

The world ruled by growing need for security and the “War on Terror” that marked the past ten years resulted into a global paranoia. Often exaggerated measures of security that involve 24/7 surveillance of communication and people’s movements severely violates the right to privacy.

The Republic of Macedonia faces additional challenges a propos right to privacy. Surveillance and other security measures that (may) hamper the right to privacy are not clearly put under civilian/parliamentarian control. Under the cover of security, fight against organized crime, traffic safety and other excuses, surveillance is used to interfere with lives of people, including political opponents, journalists, independent intellectuals, civil society and human rights activists, as alleged by various sources. There is no easy way of proving these allegations, having in mind the nature of these activities and the institutions that have the capacity to carry out these violations.
