Universal Declaration of Human Rights: Аrticle 9: No one shall be subjected to arbitrary arrest, detention or exile.
No one is allowed to limit your freedom arbitrarily. The Universal Declaration guarantees that for every human. Arbitrary arrest, arbitrary police custody or prison detention is prohibited by the Article 9 in case in which there is no evidence or likelihood that the detainee has committed a crime, or if there is no adequate legal case.
The arrest is considered arbitrary when the detainee was not given information why he/she was arrested and has not been shown an appropriate court order during the arrest. In many cases, arbitrary arrest may include isolation from family, friends, and relatives, the public or relevant authorities. Many individuals who are arbitrary arrested, suffer from severe physical or mental torture, and extrajudicial penalties.
Unfortunately, arbitrary arrest or detention in most countries is used as defense against protesters, opponents, people with opposing views… They are particularly favored measures in countries ruled by totalitarianism and dictatorship.
